Non-exempt (hourly) employees attending an overnight trip
When assigning a non-exempt (hourly) employee to assist with an overnight trip, the following guidelines apply:
- Supervisors must clearly communicate the designated reporting time to the employee, whether it's at SHS or the airport.
- For instance, if the reporting time is 9 am at SHS campus, employees should clock in at 9 am, even if they arrive earlier, such as at 8:30 am.
- Employees will receive their regular hourly rate for the time spent traveling with the students. Travel time is only compensated when it falls outside their regular work schedule.
- If possible, employees should be allowed to take a 30-minute unpaid lunch break before reaching the 5th of work, provided they work more than 6 hours in a day. Otherwise, a 1-hour meal penalty will be applied.
- Any hours worked beyond 8 hours in a day will be considered as overtime.
- All hours calculated during the trip will be taken into account for overtime. What this means is that hours exceeding 8 hours in a day AND 40 hours a week will be calculated as overtime.
- In cases where an employee remains on-call and is not released from all duties, they should receive compensation.
- For example, if an employee is dining at a nearby table and the students require assistance, if the employee provides aid, they should be paid. The employee will need to clock back in and be offered an opportunity to take a 30-minute unpaid lunch break.
- If the employee ignores the students and is on a true lunch break, they do not need to be paid.
- Employees have the option to take their lunch break away from the group. If a supervisor mandates that they must remain nearby, it cannot be considered a genuine lunch break and should be compensated.
- Hours worked beyond 10 hours in a single day will be compensated at double time.
- For hours during sleep periods, please refer to the example provided in guideline #5.
These parameters outline the payment and scheduling details for non-exempt employees assisting with overnight trips. It is important to note that regardless if a non-exempt spends 5 seconds or 1 minute, they should be paid for the time they work. The employee can put this time into Paycom via a punch change request.
